License Agreement

Section 01

Who this agreement is between

This agreement is between you and VibeMyWay by Federico Pizzutto ("we", "us"):

We sell the app through Lemon Squeezy, which acts as our reseller and merchant of record: it takes your payment, handles sales tax and VAT, and issues your receipt. Lemon Squeezy's terms cover the purchase itself. This agreement covers your use of the app.

This agreement adds to our general Terms & Conditions. Where the two differ, this agreement applies to the app.

Section 02

What you're purchasing

A license lets one person use the app on one Mac at a time.

• The license is perpetual: your license key does not expire.
• It covers the app and everything bundled inside it, including the MarketingKit engine, skills and templates the app runs on.
• It does not include the MarketingKit kit sold as a ZIP download. That is a separate product with its own license.
• If you buy for your organisation, the license belongs to the organisation and is used by one person at a time. You may reassign it to someone else in your organisation: deactivate it on the old Mac first (see section 3).

Section 03

Activation: one Mac at a time

• You activate the app with the license key from your purchase receipt. Activation needs an internet connection.
• The license runs on one Mac at a time. To move it, open Settings → License → Deactivate this Mac, then activate the app on the new Mac.
• If your Mac is lost, broken or was wiped before you could deactivate it, email contact@vibemyway.com with your license key and we'll reset it. We may ask for your order email to confirm it's yours.

Section 04

License checks

• While your Mac is online, the app checks your license with our license server about every 14 days.
• If a check hasn't succeeded for 21 days, the app shows a warning. After 30 days without a successful check, the app locks until it can connect and check again.
• A dropped connection or a brief outage of our server never locks the app by itself. The app locks only when the server reports that the key is invalid, disabled or expired, or when 30 days pass without a successful check.
• A locked app doesn't touch your projects. They are ordinary files in folders on your Mac, and they stay there, readable with any other tool.

Section 05

What the app sends us

Activation and license checks send our license server:

• your license key and an activation ID;
• your Mac's name (the Computer Name in macOS System Settings), so you can tell your devices apart;
• the app version.

Our license server is hosted in the EU and checks your key with Lemon Squeezy, which holds your order details (such as your name and email). Like any internet request, these checks reveal your IP address to our host and to Lemon Squeezy.

That's all. The app sends us no usage analytics, and none of your content, prompts, brand documents, files or API keys. API keys you add are stored in the macOS Keychain on your Mac.

Section 06

AI providers and other services you connect

The app generates content through an AI provider you choose. That can be Anthropic, OpenAI, Google, any OpenAI-compatible service, or your Claude or ChatGPT subscription through the provider's own command-line tool.

• Your prompts and content go directly from your Mac to that provider, under your account and that provider's terms. We don't receive or see that traffic.
• You pay the provider directly. Its prices, models and availability are outside our control.
• The same applies to image, video and design services you connect, such as Figma or Canva.

Section 07

What you can do

• Use the app for personal projects: side projects, personal brand, individual use.
• Use the app for client work: generate content for your clients as part of your services.
• Use the app commercially: generate content that supports revenue-generating products or businesses.
• Customise the skills, templates and brand documents inside your own projects to fit your workflow.

Section 08

What you cannot do

• Share your license: you may not share your license key, or use the app on more Macs than your license allows.
• Get around the licensing: you may not bypass, disable or tamper with license activation or checks. That includes patching the app, faking our license server, or reverse engineering the app to do so, except where the law expressly allows it.
• Redistribute the app: you may not share, publish or upload the app, or the skills and templates bundled in it (original or modified), to anyone who hasn't bought their own license.
• Sell or sublicense the app: you may not sell, rent, lease or sublicense the app or any part of it.
• Build a competing product from it: you may not use the bundled skills, templates or engine to create a product that you sell or distribute.
• Remove notices: you may not remove copyright or license notices from the app.

Section 09

Content you generate

Content you generate with the app belongs entirely to you: lead magnets, articles, emails, social posts, landing pages, videos and the rest. There are no restrictions on how you use, publish, sell or distribute it.

• Pages, web designs and videos carry a small "Made with vibemyway.com" credit by default. You may remove it.
• AI-generated content can be wrong. Review everything before you publish it, including facts, claims, image rights, and compliance with advertising rules in your market. That review is your responsibility.

Section 10

Updates

Every future update is included with your license at no extra cost. There is no renewal or upgrade fee.

The app does not update itself. New versions are published on your Lemon Squeezy order page, linked from your purchase receipt. You can download the latest version there at any time, and your license key works with every version.

If we ever discontinue the app, we will publish a final version that works without license checks, so your copy keeps working.

Section 11

Refunds

You can ask for a refund within 14 days of purchase by emailing contact@vibemyway.com or replying to your receipt email. Refunds are processed through Lemon Squeezy. When an order is refunded, its license key is disabled, and the app locks at its next license check.

This 14-day window replaces the "all sales are final" rule in section 8.4 of our general Terms for this app. Lemon Squeezy's own refund and chargeback policy also applies to the payment.

Section 12

Termination

Your license ends automatically if you breach this agreement. We may also disable a license key if its order is refunded, charged back or fraudulent, or if the key is used in breach of this agreement.

When your license ends, you must stop using the app and delete it. Your projects and the content you generated remain yours.

Section 13

No warranty

The app is provided "as is", without warranty of any kind, express or implied. We make no guarantees about:

• fitness for a particular purpose;
• the accuracy of generated content;
• the availability of third-party AI providers or services;
• uninterrupted operation of the app or the license server.

Nothing in this agreement excludes liability that cannot be excluded under applicable law.

Section 14

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the app, even if we were told they were possible. Our total liability is limited to the amount you paid for your license. These limits don't apply where the law doesn't allow them, for example in cases of intent or gross negligence.

Section 15

Changes to these terms

We may update these terms for future versions of the app. Each version is covered by the terms that ship with it, and a change never applies retroactively to a version you already have.

Section 16

Governing law

This agreement is governed by the laws of the Grand Duchy of Luxembourg, without regard to its conflict-of-laws rules. The courts of Luxembourg City have exclusive jurisdiction.

Before starting court proceedings, please email contact@vibemyway.com with the subject line "Dispute". Most things can be resolved that way.

The English version of this agreement is authoritative. Translations, if offered, are for convenience only.
